Required Documents for Trademark Filing

To apply for trademark registration in India, the following documents and details are required for smooth filing and processing.

Applicant Details

Name, address, nationality, email ID and contact number of Individual / Company / LLP / Partnership firm.

Trademark / Brand Details

Clear logo (JPEG format) or wordmark, description of goods/services and relevant trademark class.

Identity Proof

PAN Card and Aadhaar / Passport of applicant. For companies: Certificate of Incorporation & Authorized Signatory ID.

Address Proof

Utility bill, rent agreement, or business registration document showing registered address.

MSME / Startup Certificate (Optional)

Udyam Registration or DPIIT Startup Recognition Certificate for concessional government fees.

Power of Attorney (TM-48)

Required if the trademark application is filed through a trademark agent or legal professional.

User Affidavit (If Already in Use)

Declaration of first use date along with supporting documents such as invoices, advertisements or website proof.

Any individual, startup, MSME, private limited company, LLP, partnership firm, or sole proprietorship can apply for trademark filing in India.

The trademark application is usually filed within 1–2 working days. After filing, an Application Number is generated immediately, and the ™ symbol can be used.

After filing, the application goes through examination by the Trademark Officer. If no objection is raised, the mark is published in the Trademark Journal and later registered if no opposition is filed.
